These Terms govern your use of ProofKit, an open marketplace connecting users with independent VPN node operators. Please read them together with the Acceptable Use Policy, Privacy Policy, and Refund Policy.

01 /Acceptance

By accessing or using ProofKit you agree to these Terms. If you do not agree, do not use the service.

02 /What ProofKit is

ProofKit is an open marketplace that connects you with independent node operators and settles payments through a non-custodial TON escrow contract. ProofKit is not a traditional VPN provider running its own fleet — the nodes are run by independent operators who set their own prices and policies.

03 /Eligibility

You must be of legal age in your jurisdiction and not barred from using the service under applicable law or sanctions.

04 /Accounts

You are responsible for activity on your account and for keeping your credentials safe. Two-factor authentication (TOTP or Telegram) is available and recommended.

05 /Payments and escrow

Pricing is pay-per-GB and set by operators. You deposit TON into a non-custodial escrow contract; charges are deducted for measured bandwidth. Unused balance is withdrawable directly from the contract at any time, subject to settlement of pending charges. See the Refund & Withdrawal Policy.

06 /Acceptable use

You agree to the Acceptable Use Policy. We and operators may suspend or terminate access for violations.

07 /Operators

Operators set prices and node policies, stake a TON deposit, and may be automatically slashed for misbehavior (for example, misreporting bandwidth). ProofKit does not guarantee any operator's conduct, uptime, or jurisdiction.

08 /No warranty

The service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee uptime, availability, speed, or that any route will bypass censorship in any region. Censorship techniques evolve and no tool can promise permanent access.

09 /Limitation of liability

To the maximum extent permitted by law, ProofKit and its contributors are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, funds, or access. Nothing here limits liability that cannot be limited under applicable law.

10 /Crypto risk

TON is a volatile cryptocurrency and the escrow is permissionless. On-chain transactions are irreversible and may be affected by network conditions or law. You accept the risks of using crypto payments.

11 /Intellectual property

ProofKit is an open project. Third-party names and trademarks (clients, protocols, networks) belong to their respective owners.

12 /Termination

We may suspend or terminate access for violations of these Terms or the Acceptable Use Policy. You may stop using the service and withdraw your unused balance at any time.

13 /Governing law and disputes

These Terms are provided as-is and do not designate a specific national jurisdiction or governing law. Disputes will be addressed in good faith through the contact below. Nothing in these Terms waives mandatory consumer-protection rights you may have under your local law.

14 /Changes

We may update these Terms; the “Last updated” date will change and continued use constitutes acceptance.
